  В статье рассматривается значение ВТО в международной торговле, анализируется опыт вступления в ВТО и отражаются последствия присоединения к этой организации таких государств — участников СНГ, как Кыргызстан, Украина и Армения; сопоставляются ожидаемые результаты и факторы влияния реальных последствий на экономическое развитие России в условиях ВТО.

  Consequences of accession to the WTO of states-members of the CIS and Russia

  The article considers significance of the WTO in international trade, analyses experience of accession to the WTO and reflects consequences of accession to this organization of such states — members of the CIS as Kyrgyzstan, Ukraine and Armenia, compares the expected results and real consequences for the economic development of Russian in conditions of the WTO.

  Статья посвящена оценке последствий вступления России во Всемирную торговую организацию для государств — членов Таможенного союза. Автором производится анализ влияния Таможенного союза и Всемирной торговой организации на динамику внешнеторгового оборота России, Белоруссии и Казахстана.

  В статье проанализировано одно из основных понятий таможенного права — «таможенная территория», проведен сравнительно-правовой анализ указанной дефиниции в нормативных актах Таможенного союза и Европейского союза, приведены определения «таможенной территории», закрепленные в законодательных актах государств — членов Таможенного союза и отдельных государств бывшего СССР. Особое внимание уделено проблеме изменения (преобразования) таможенной территории Таможенного союза, предложена авторская концепция Единого порядка вхождения (выхода) в (из) таможенный союз.

  Problem of transformation of customs territory of the Customs Union Belarus — Kazakhstan — Russia

  In the article the analyses of one of the basic customs law notions — “customs territory” is given. Comparative law analyses of this term used in the Customs Union and the European Union normative acts is made. The definitions of “customs territory” fixed in acts of legislation of the Customs Union member states and individual states of Former USSR are shown. The author places high emphases on the problem of changing (transformation) of the Customs Union customs territory and suggests his own concept of the unified procedure of entering (leaving) the Customs Union.

  В статье речь идет о некоторых критериях подготовки специалистов в области таможенного дела в зарубежных странах, в т. ч. в странах постсоветского пространства. Автор рассматривает подготовку подобного рода специалистов в Австралии, Германии, Великобритании, Литве, Казахстане. Автор доклада предпринимает попытку выявить общие черты в национальных моделях подготовки специалистов по таможенному делу. Действующая система правового регулирования слабо реагирует на процессы глобализации на фоне создания единого образовательного пространства и предполагает унификацию норм национального законодательства в рамках гармонизации инструментов правового регулирования.

  Foreign experience of training of specialists on specialization «Customs Affairs»: Great Britain, Germany, Australia, Lithuania, Kazakhstan

  The article concerns some criteria of training of specialists in the sphere of customs affairs in foreign states, including in the states of post-Soviet space. The author considers training of such specialists in Australia, Germany, Great Britain, Lithuania and Kazakhstan. The author of the paper attempts at detecting similar features in national models of training of specialists of customs affairs. The current system of legal regulation underreacts to the processes of globalization against the background of creation of a single educational spaces and provides for unification of rules of the national legislation within the frameworks of harmonization of instruments of legal regulation.

  Problem of scientific conceptualization of customs legal relations

  The author considers the role of customs law in the system of Russian law, points out the specifics of subjectmatter and methods of customs regulation. The special attention is drawn to legal ensuring of fiscal function of customs agencies, juridical feasibility of definition and correction of customs cost, evaluation of probative value of price information.
