ГОСРЕГУЛИРОВАНИЕ В СФЕРЕ ИНТЕЛЛЕКТУАЛЬНОЙ СОБСТВЕННОСТИ В ОПК

В статье исследуются особенности деятельности государственных заказчиков и организаций оборонно-промышленного комплекса в сфере интеллектуальной собственности, в частности, особенности правовой охраны РИД. В статье рассматриваются следующие нарушения законодательства при заключении государственных контрактов: нарушения и недостатки, допускаемые на этапе заключения государственных контрактов и имеющие наиболее негативные последствия для результатов работ в рассматриваемой области, нарушения, допускаемые при выполнении работ. Решение указанных проблем необходимо начать с включения в государственные контракты на выполнение НИОКР условий, касающихся создания новых (охраноспособных) результатов, обеспечения их правовой охраны, дальнейшего использования для создания инновационной продукции. При этом необходимо принять соответствующий нормативный правовой акт Правительства Российской Федерации, регулирующий обязательное включение в госконтракты таких условий.

Analysis of state customers and organizations of military-industrial complex in the area of intellectual property management of audit Rospatent
The article investigates the features of the activities of government customers and organizations of military-industrial complex in the area of intellectual property, in particular: to the legal protection of RID. Implementation of the control function of Rospatent revealed major violations of the law and the conditions of government contracts permitted at the conclusion of public contracts, their performance and acceptance of the results thereof, and to develop and implement measures to eliminate them. This article discusses the following violations of the law at the conclusion of public contracts: violations, is allowed to step on state contracts and having the most negative impact on the results of work in that field, lapses in the performance of work. Rospatent implementation of control measures led to the conclusion not only of the existing violations of the law of intellectual property, but also about the lack of demand created by the results of the market. The solution of these problems, you should start with the inclusion in state contracts for R & D provisions relating to the creation of new (patentable) results, to ensure their legal protection, further use for the creation of innovative products. It is necessary to adopt an appropriate normative legal act of the Government of the Russian Federation, which regulates the mandatory inclusion in state contracts such conditions.

Для согласования интересов государства, частного партнера и разработчика в рамках реализации экономических проектов в ОПК для достижения целей государственного управления представляется возможным применение различных форм государственно-частного партнерства. В статье рассматриваются проблемные вопросы существующей системы государственного учета, выделяются нормативные, организационные и технические предпосылки его совершенствования.

Контроль и надзор в сфере интеллектуальной собственности на предприятиях ОПК С. 9-10
Рассекречивание значительной части документов сделало практически бесконтрольным использование содержащихся в них сведений третьими лицами. В результате длительного отсутствия нормативно-правового регулирования этой сферы деятельности, в том числе в Вооруженных Силах Российской Федерации, не была своевременно налажена действенная система охраны и защиты экономических интересов государства в сфере реализации прав Минобороны России как госзаказчика на объекты интеллектуальной собственности, полученные за счет средств федерального бюджета. Это влекло утрату прав государства на полученные за счет государства результаты интеллектуальной деятельности и использование их подчас в ущерб интересам обороны. Автор убежден, что необходима срочная инвентаризация РИД, содержащихся в документации, что позволит создать надлежащие условия для максимального применения полученной на предприятиях оборонно-промышленного комплекса интеллектуальной собственности в интересах развития инновационного гражданского сектора экономики.

Control and supervision in the field of intellectual property in the military-industrial complex

As a result of the long absence of legal regulation of this sphere of activity, including the Armed Forces of the Russian Federation was not timely been established an effective system for the protection and protection of the economic interests of the state in the implementation of the rights of the Russian Defense Ministry, as the government customer intellectual property obtained at the expense of the federal budget. This led to the loss of the rights of the state obtained by the state intellectual property, and use them sometimes to the detriment of the interests of the defense. As the results of supervisory activities of the territorial and military prosecutors problems with the legal protection of intellectual property in the authorized federal bodies and enterprises of the military-industrial complex remain unresolved: in contracts for the execution of any other work for the Ministry of Defense are often laid on the implementation of the duties of performers particular set of legislation governing actions for the protection of intellectual property rights created by the budget in the execution of the state defense order. The author is convinced that the ongoing public authorities and enterprises of the military-industrial complex work, including, and implementation at the federal level under consideration at the conference will help to solve this problem as soon as possible and to create appropriate conditions for the maximum application received at the enterprises of the military-industrial complex intellectual property for the development of innovative civil sector.

Доклад по теме «Стандартизация интеллектуальной собственности в ОПК» был представлен автором (по решению руководства Росстандарта) как председателем российского Национального технического комитета по стандартизации в сфере интеллектуальной собственности ТК-481. Для того чтобы мы свой приоритет в рамках ВТО использовали, для этого нужно, чтобы у нас эти национальные стандарты были. А вот что мешает сегодня, какие проблемы здесь есть и каковы перспективы их решения — об этом идет речь в статье.

Standardization of intellectual property management in the defense industry
The paper was prepared on the basis of the author’s lecture on «Standardization of intellectual property in the defense industry», presented to them by management Rosstandart as chairman of the Russian National Technical Committee for Standardization in the field of intellectual property TK-481. Speaking about the standardization of the rules that may be applied, we assume the following. In contrast to the norms of international law, if international standards are contrary to the national, the priority is given to national standards. In law, everything is different. But in order for us the priority in the framework of the WTO used, it needs to have these national standards were. But what prevents today or what problems there are and what are the prospects for their decisions about it, in fact, and will be discussed in a brief general overview of the conditions that need to see and understand, and those specific issues that also require our attention and solutions, including at the leadership level of holdings, enterprises and public authorities.

ЭКОНОМИКА ИНТЕЛЛЕКТУАЛЬНОЙ СОБСТВЕННОСТИ

Доля применения инновационных технологий в оборонно-промышленном комплексе России в целом выше, чем в других отраслях промышленности, но все же в сравнении с мировыми показателями является низкой. Именно поэтому стимулирование инновационной деятельности должно быть главной задачей Правительства РФ и региональных властей. Правительство Ульяновской области направляет основные усилия на формирование инфраструктуры, системы подготовки кадров через реализацию следующих проектов: 1) создание Нанотехнологического центра; 2) создание инжинирингового центра в области моделирования и разработки композитных материалов («АрТек Композитс»); 3) создание инжинирингового центра ядерно-инновационного кластера в Димитровграде; 4) создание Центра молодежного инновационного творчества; 5) разработка и реализация подпрограммы «Развитие инновационной деятельности в Ульяновской области»; 6) развитие авиационного кластера (одним из этапов развития авиационного кластера является создание в регионе Центра российского транспортного авиастроения); 7) создание Регионального центра интеллектуальной собственности и подготовка специалистов в сфере управления интеллектуальной собственностью в авиастроении. Только при разработке действенных механизмов учета интеллектуальной собственности в производственно-хозяйственной деятельности организаций оборонно-промышленного комплекса и государственной (законодательной) поддержке и защите результатов интеллектуального труда Ульяновской области удастся добиться формирования представления об интеллектуальной собственности как о товаре, что, в свою очередь, послужит повышению эффективности стратегического управления в промышленной сфере.

Market mechanisms and indicators of the practical implementation of the strategy of innovative development of Russia's economy in the defense industry through intellectual property
The share of innovative technologies in the military-industrial complex of Russia as a whole is higher than in other industries, but still compared to the global rate is low. That is why the promotion of innovation should be the main task of the Russian Government and the regional authorities. The Government of the Ulyanovsk region directs its efforts on building the infrastructure, the training system through the implementation of the following projects: 1) Create Nanotechnology Center; 2) Create an engineering center in the field of modeling and design of composite materials («Artek Composites»); 3) Create an engineering center nuclear innovation cluster in Dimitrovgrad; 4) Establishment of the Centre Youth Innovation creativity; 5) Development and implementation of the subprogram «Development of innovative activity in the Ulyanovsk region»; 6) The development of the aviation cluster. One of the stages of development of the aviation cluster is to create a regional center of the Russian transport aircraft industry; 7) Establishment of Regional Center of Intellectual Property, and training in the management of intellectual property in the aviation industry. Only in the development of effective mechanisms for accounting intellectual property in industrial and economic activities of the organizations of the military-industrial complex and the state (legislative) support and protect the results of intellectual work of the Ulyanovsk region will be able to achieve the formation of ideas about intellectual property as a commodity, which, in turn, will serve to increase effectiveness of strategic management in the industrial sector.

Проблема обращения военно-промышленного комплекса, или ОПК, как называют сегодня, к гражданскому сектору имела историю достаточно длительную. Стратегической задачей кратко- и среднесрочной перспективы является реиндустриализация национальной экономики, ориентированная на инновационную модернизацию производства, осуществлять которую (инновационную модернизацию) большинство промышленных предприятий не торопится. Формированию условий для обеспечения данного процесса препятствуют как минимум пять групп факторов: 1) деформированная структура экономики; 2) низкий уровень оплаты труда в промышленности; 3) кадровый голод; 4) пространственная сверхконцентрация носителей интеллектуальной собственности; 5) утрата значительной части объектов интеллектуальной собственности. Решение задачи использования интеллектуальной собственности ОПК для гражданских нужд следует искать не внутри ОПК, а в разработке стратегии реиндустриализации экономики России.

Staffing processes of intellectual property management in the defense industry and the use of intellectual property defense industry in the civilian sector of the economy

УПРАВЛЕНИЕ ИНТЕЛЛЕКТУАЛЬНОЙ СОБСТВЕННОСТЬЮ В КОРПОРАЦИИ

Управление интеллектуальной собственностью госкорпорации «Росатом» неразрывно связано с созданием в 2012 г. системы управления знаниями, обеспечивающей переход от управления НИР и ОКР к управлению инновациями. Для решения основных проблем, возникающих при управлении интеллектуальной собственностью при выполнении государственного оборонного заказа в ядерном оружейном комплексе, автором предлагаются рекомендации: внести изменения в законодательство в отношении безвозмездных лицензий; ввести в государственные контракты целевое плановое финансирование в виде статей расходов исполнителя на проведение патентных исследований и обеспечение правовой охраны результатов интеллектуальной деятельности.

Management of intellectual property in the performance of the state defense order in the nuclear weapons complex
Management of intellectual property of the State Corporation «Rosatom» is inextricably linked with the creation in 2012, the knowledge management system that provides a transition from the management of R & D to innovation management. Intellectual property management system is determined by the specific nature of the nuclear weapons complex: first, the nomenclature of RIA, including information constituting a state secret, the implementation of the functions of the state customer of the works; Second, technological capabilities, computing and information base, a single information space, a typical information system; Third, the close interaction with the legal services under the protection and commercialization of corporate knowledge. The main problems encountered in the management of intellectual property in the performance of the state defense order in the nuclear weapons complex: 1) the provisions of Rules 10 and 11 of the state customers RMS Russian Federation on the results of intellectual activities of civil, military, special and dual purpose actually defeats the purpose of the concept of «result of dual-use», limiting the scope of its activities the state defense order and military-technical cooperation, eliminating the possibility of using such RID in the civilian sector of the economy; 2) the problem of gratuitous license agreements. To solve them, the author offers the following recommendations: to amend the legislation in respect of royaltyfree license. В статье представлен доклад автора на круглом столе «Проблемы и условия формирования регионального рынка интеллектуальной собственности для реиндустриализации российской промышленности» в рамках Уральского транспортного салона «МАГИСТРАЛЬ-2014», а также на круглом столе «Инновации в оборонно-промышленном комплексе. Интеллектуальная собственность для реиндустриализации российской промышленности» в рамках конгрессно-деловой программы VII Петербургского международного инновационного форума 2 октября 2014 г., проведенного под эгидой коллегии Военно-промышленной комиссии Российской Федерации. В статье рассмотрены основные этапы построения системы управления интеллектуальной собственностью на предприятии, проблемы, появившиеся в рамках данного процесса, рассмотрены результаты от внедрения данной системы управления. Сделаны основные выводы относительно уровня экономики интеллектуальной собственности на предприятиях ОПК и обозначены перспективы развития рынка интеллектуальной собственности.

The mechanism of intellectual property management, and economic factors influencing pricing
The article presents the report of the General Director of the Ural Design Bureau railcar Alexander Levin at the round table «Problems and conditions of formation of the regional market of intellectual property for the re-industrialization of the Russian industry» within the Ural vehicle cabin «HIGHWAY -2014», held September 5, 2014 in Nizhny Tagil, Sverdlovsk region and organized by the Government of the Sverdlovsk Oblast, Ural Federal University, JSC «SPC» Uralvagonzavod intellectual Corporation NSRIIP property. The report describes the main steps of building a system of intellectual property management at the enterprise. Problems emerged within the framework of this process, consider the results of the implementation of this control system. Main conclusions are made regarding the level of intellectual property economics and defense industry enterprises, the prospects of development of the market of intellectual property.

В статье рассматриваются актуальные вопросы таможенной защиты интеллектуальной собственности при экспорте продукции военного и двойного назначения, компетенции таможенных органов в данной сфере, имеющиеся проблемы и пути их решения. Таможенная защита прав интеллектуальной собственности без включения соответствующих объектов в Таможенный реестр объектов интеллектуальной собственности и Единый таможенный реестр объектов интеллектуальной собственности не будет максимально обеспечена. Для повышения ее качества, в связи с активно развивающимися интеграционными процессами в рамках Таможенного союза и Единого экономического пространства, создана двухуровневая система защиты права интеллектуальной собственности посредством формирования национальных таможенных реестров объектов интеллектуальной собственности и Единого таможенного реестра объектов интеллектуальной собственности государств — членов Таможенного союза, ведение которых выполняется Федеральной таможенной службой в полном объеме. Перспективы интеграционных процессов, связанные с началом функционирования Евразийского экономического союза, предусматривают дальнейшую гармонизацию законодательства в области защиты прав интеллектуальной собственности и, следовательно, более высокий уровень защиты прав интеллектуальной собственности, поскольку товарный знак, внесенный в Единый реестр объектов интеллектуальной собственности, будет охраняться как в Российской Федерации, так и в остальных государствах — членах Таможенного союза.

The role of customs in protecting intellectual property for export of military and dual-use
The article discusses current issues of customs protection of intellectual property for export of military and dual-use customs authorities in this area, existing problems and ways to solve them. Customs protection of intellectual property rights without the inclusion of relevant objects in the Customs Register of Intellectual Property and the Common Customs Register of Intellectual Property will not be the most assured. In order to improve its quality, and therefore actively developing integration processes within the framework of the Customs Union and the Common Economic Space, created a two-tier system of protection of intellectual property rights through the establishment of national customs registry of intellectual property and the Common Customs Register of Intellectual Property of — members of the Customs Union, conducting which is performed by the Federal customs Service in its entirety. Prospects of integration processes associated with the initiation of the Eurasian Economic Union, provide further harmonization of legislation for the protection of intellectual property rights, and therefore a higher level of protection of intellectual property rights as a trademark registration in the Unified Register of Intellectual Property, will be protected as in the Russian Federation, as well as in other countries — members of the Customs Union.

В нем приняли участие более 50 руководителей и представителей федеральных служб, научно-исследовательских центров, Санкт-Петербургского регионального отделения Союза машиностроителей России, предприятий оборонно-промышленного комплекса, руководителей предприятий и компаний, заинтересованных в системной работе по коммерциализации интеллектуальной собственности и использовании ее в развитии бизнеса, использовании технологий двойного и гражданского назначения, созданных на предприятиях ОПК г. Санкт-Петербурга. В рамках круглого стола было заслушано пять докладов и поддержан итоговый документ — рекомендации секции № 7 II Военно-промышленной конференции «Управление интеллектуальной собственностью в оборонно-промышленном комплексе».
